Method of Sale
The Property is offered for sale by private treaty as a whole. The right is reserved to take the Property to auction or tender at a later date.
Single Farm Payment
The land is registered on the Rural Land Register and under the Single Farm Payment Scheme.
Single Farm Payment Entitlements comprising 74.14 NML Entitlements and 7.41 SAS Entitlements will be made available, if required, by separate negotiation. The NML Entitlements have a 2007 value of €532.85 per Entitlement for use by the Scheme Year 2010. The SAS Entitlements have a 2007 value of €95.13 per Entitlement for use by the Scheme Year 2010. The Vendor has submitted a claim on 15 May 2008 and shall retain all payments for this Scheme Year. The Purchaser shall indemnify the Vendor in respect of cross compliance until the end of the Scheme Year.
Tenant Right & Holdover
The Vendor will proceed to an early exchange of contracts but would like to retain the growing crops on terms to be agreed. Therefore subject to these terms and any Holdover provisions agreed between the Vendor and the Purchaser, there shall be no claim for any ingoing tenant right and no counter claim(s) whatsoever will be allowed, unless it is agreed that the Purchaser takes possession of the growing crops, which shall be purchased at valuation.
Sporting Rights
Sporting Rights will pass with the freehold but are held by Brian Frank Lukehurst under a gentleman’s agreement with the Vendor. Under the terms of that agreement the Sporting Rights shall be held by Mr Lukehurst until the earlier of his death or 1 February 2014 whereupon they will pass to the freeholder.
Rights & Easements
